FORTE is an AI-powered recruitment platform that helps organizations streamline their hiring process by:

Analyzing candidate profiles and resumes using artificial intelligence
Matching candidates to job requirements based on skills, experience, and competencies
Providing data-driven insights for hiring decisions
Multi-channel job syndication and distribution across verified partner job boards, search engines, and talent aggregators

The Platform uses advanced AI and machine learning technologies to assess candidate potential and job fit.

3. User Accounts and Registration

To use certain features of the Platform, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and account
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Platform in any way that violates applicable laws or regulations

Attempt to gain unauthorized access to the Platform or related systems
Interfere with or disrupt the Platform or servers
Use automated systems or software to extract data from the Platform without permission

Use the Platform to harass, abuse, or harm another person

5. Content and Data

5.1 Your Content

You retain ownership of all content you submit to the Platform, including job descriptions, candidate information, and other data ("Your Content"). By submitting Your Content, you grant FORTE a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze Your Content solely for the purpose of providing and improving the Platform services.

5.2 Job Postings and Syndication Authorization

When you submit or publish a job posting on FORTE, you represent and warrant that you have all necessary rights, legal authority, and consents to advertise the position on behalf of the hiring organization. By publishing a vacancy or enabling multi-channel sourcing, you grant FORTE a worldwide, royalty-free authorization to syndicate, format, broadcast, and distribute the job listing, including company name, brand trademarks, job descriptions, and application URLs, across third-party job boards, search engines, and talent aggregator networks (such as Google for Jobs, Talent.com, Jooble, LinkedIn, and partner syndication channels) to attract job seekers to your posting.

5.3 Candidate Data

When processing candidate data, you represent and warrant that:

You have obtained all necessary consents to collect and process candidate information
You comply with all applicable data protection and employment laws
You will use candidate data only for legitimate recruitment purposes

5.4 AI-Generated Content

The Platform uses AI to generate analyses, insights, and recommendations. While we strive for accuracy, AI-generated content should be used as a tool to assist decision-making, not as the sole basis for employment decisions. You remain responsible for all hiring decisions.

6. Subscription and Payment

Access to certain features of the Platform requires a paid subscription. By subscribing, you agree to:

Pay all fees associated with your chosen subscription plan
Provide accurate and complete billing information
Authorize us to charge your payment method for recurring subscription fees

Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, but no refunds will be provided for partial subscription periods unless required by law.

We reserve the right to modify subscription pricing with reasonable notice to existing subscribers.

7. Intellectual Property

The Platform, including its software, algorithms, design, text, graphics, and other content (excluding Your Content), is owned by FORTE and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Platform or its underlying technology without our express written permission.

8. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

We implement appropriate technical and organizational measures to protect your data, but no system is completely secure. You acknowledge that you provide your information at your own risk.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

9.2 AI Accuracy

While our AI technology is designed to provide accurate and helpful insights, we do not warrant that AI-generated analyses, recommendations, or predictions will be completely accurate or suitable for your specific needs. You should exercise independent judgment in all hiring decisions.

9.3 Limitation of Liability

To the maximum extent permitted by law, FORTE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless FORTE, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination:

Your right to use the Platform will immediately cease
We may delete your account and all associated data
You remain liable for all charges incurred prior to termination

You may terminate your account at any time by contacting us or using the account settings in the Platform.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
